If you have any questions or need further explanation on any issue please do not hesitate to contact us.

Note be aware:  Many motorhome companies do not display their T&C's online and then produce their T&C's the day of collection of the motorhome thereby not allowing the customer the opportunity to read and understand the contents in a relaxed and timely manner, and then expect the customer to agree and sign a copy, often agreeing to terms & charges that were not explained to them at the time of the initial booking.

Definitions

‘Driver(s)’ means only the person or persons named as the driver(s) on the booking form.
“Customer”, “You" and "Your" or "Hirer" means the driver together with all other persons named on the booking form (including anyone added or substituted at a later date) and any person whose credit card is presented for payment of the hire charges or security deposit.

‘CMH’ or ‘we’ or ‘us’ means Circle Motorhome Hire

‘Hire period’ means the agreed rental period as defined on your booking confirmation email, hire agreement documentation, final invoice and any additional period during which the motorhome is in your possession or control.

‘Motorhome’ means the motorhome hired by you and includes tyres, tools, accessories & all other equipment or documents or additional hire items related to the motorhome and any replacements or substitute motorhome that may be provided by us.

Your Contract

Your contract is with Circle Motorhome Hire

Your contract with us comes into existence when we send confirmation of your booking to you in a written form by either letter or email.

You should check the details of your confirmation email carefully to ensure that it reflects the booking you have requested and inform us immediately of any discrepancies, as it may not be possible to make changes later.

If you commit any breach of this agreement, we may treat the agreement as terminated. In this situation we will not be liable for any refunds, compensation, losses or expenses, including any return or onward travel arrangements.

Booking & Payment

Availability is on a request and confirm basis at the time of reservation.

A reservation is only binding after it has been confirmed by CMH and a NON-returnable deposit payment of £360 (£300 plus vat) has been received.

The deposit will be deducted from the total hire charge at time of paying balances.

Our terms and conditions including cancellation policy apply from this point onwards.

Once the reservation is confirmed, a confirmation *email will be sent out to the customer (*or by post).

Settlement of the remaining balance will be due eight weeks prior to departure.

CMH reserves the right to cancel the booking if payment is not received eight weeks prior to departure.

Payment is by credit card (Visa or MasterCard only), debit cards, bank transfers in Pounds Sterling.

For late bookings (less than eight weeks before departure) the full rental price is payable on booking.

Motorhomes will not be released without full payment being completed.

 

Drivers

Maximum of three drivers per rental.

No driver may drive a hire motorhome unless he/she is aged between 25 and 70 for standard rates, or 71-79 subject to additional insurance premiums.

Holds a full driving licence valid to drive in the UK and has not been disqualified.

Has held a full driving licence for more than 24 months that entitles them to drive a UK category B motorhome up to 3500kg GMW.

Has not been convicted of any criminal / driving offences other than speeding and parking offences. 

Other conditions as follows:

The maximum penalty points our insurance will accept on the UK licence is 6, however we may be able to cover you subject to our insurers approval.

Endorsements on licences: you must declare at the time of booking if there are any endorsements on your licence.

We can accept up to 6 speeding points that occurred within the last 2 years (charges may apply).

For more than 6 points, or for any conviction other than for speeding, including the following codes: AC, BA, CD, DD, DR, IN, LC, MS, UT, MR and TT or for any driver disqualification within the last 5 years CMH may not be able to get cover.

You must declare at the time of booking if you have made or had vehicle insurance claim made against you within the last 5 years.

CMH may not be able to get cover should you have had 2 or more claims within the last 3 years.

Accidents where the driver was not at fault must also be declared.

Does not suffer from any physical or mental defects which would affect the driver’s ability to drive the motorhome in accordance with legal requirements and/or the driver has not been advised not to drive on medical grounds by the driver’s G.P. or other medical personnel.

Has never been refused motor insurance.

Is not employed in a ‘high risk’ occupation as defined by our insurer. Please contact us if you are in any doubt.

Driver occupations: you must declare your occupation on collection of the motorhome.

CMH MAY not be able to offer cover for the following occupations:

Celebrities  - Sports personalities - Musicians - Entertainers - Serving Foreign Armed services personal - Embassy employees based in the UK -  Students under the age of 30

Should the driver not disclose that they fulfil one of the above occupations even in a part time capacity, this will render the agreement as void and the customer will be fully liable.

ALL drivers MUST produces a valid driving licence upon collection of the motorhome.

Licences from the following countries are accepted: all EU countries, USA, Canada, Singapore, Australia & New Zealand.

Licence holders from other countries must receive approval from CMH prior to booking. 

It is your responsibility to check this before making a booking.  Any cancellations resulting from a failure to meet the driver criteria will be subject to our standard cancellation terms.

You authorise us to verify through credit agencies, the Driver and Motorhome Licensing Agency, his/her employer or any other sources his/her personal, driving and credit information.

We may refuse to hire you the motorhome for any reason whatsoever at our sole discretion.

All drivers must be declared at the start of your hire & named on your booking form and MUST be present at the commencement of hire.

Drivers holding only an automatic licence can only hire our auto models and this must be declared at the time of booking.

You acknowledge that it is illegal for an undeclared driver to operate a rental motorhome, as they will not be insured.

Visitors from abroad are advised to obtain an International Driving Licence.

If you have a photo-card GB licence we require the photo-card and your NI (National Insurance) number to check your licence details on the DVLA’s online system.

We are unable to insure you if we have not DVLA checked your licence details. Full details will be given at the time of booking

If you have a modern Northern Ireland licence we require both the photo-card and paper counterpart.

Your licence address must be your current home address, if not, then in addition to this we require either a utility bill, bank statement which has your name and current address listed

All drivers who licences are issued outside of the EU or Commonwealth are required to supply a valid International driving permit alongside your standard licence at the start of hire. This must be issued in the country your standard licence was issued and confirm you are able to drive a UK category B motorhome up to 3500kg GMW.

Should any driver fail to present all correct documentation and identification on collection of the motorhome or do not meet the driver requirements stated in the terms and conditions, then CMH will be unable to release the motorhome and no refunds will be given.

Drivers are personally liable for all legal penalties (e.g.: parking tickets, congestion charges, speeding fines) which are incurred during the period of hire.

CMH is unable to insure any driver with no fixed abode.

 

If you do not meet these criteria it does not automatically disqualify you from driving, but we shall need to refer to our insurance company to check if they will offer insurance cover. It is highly unlikely that additional costs will be charged but the damage deposit/insurance excess may be increased by the insurer in some circumstances. Please just contact us for more details.

 

Collection and return of the Motorhome

You will collect the motorhome at the time and location chosen on your booking.  Please allow up to one hour for the hand-over process.

All drivers MUST be present on collection of the motorhome and have with them the following:

Full valid driving licence with photo ID (must match proof of address)

National insurance number (for UK residents only)

International licence if required (countries outside the EU)

Passport for all non UK residents or persons with no photo ID on their driving licence  

Two forms of proof of address to include:

All documents must be dated within 90 days of the hire date

One or two utility bills.

If utility bills are not possible the following documentation is acceptable for proof of address.

Council tax bill/statement

TV/internet/landline telephone bill (Including Sky/Virgin/BT etc)

Bank statement

Credit Card bill

Mortgage statement

Any documentation relating to insurance or mobile phones bills will be declined

Please note that the address on the ID must match the address that appears on the driving licence where applicable.

International customers must also provide their passport.

Should any driver fail to present all the correct documentation and identification on collection of the motorhome or not meet the driver requirements stated in the terms and conditions, then we will be unable to release the motorhome and no refunds will be given.

UK licence holders must bring their paper or photo card licence along with a print out of your driver record from the DVLA or we can do this for you.

We will advise on this at the time of booking

You will return the motorhome in a clean condition with a full tank of fuel and gas, on the return date, on the time and at the location set out in the rental agreement or agreed separately.

Please allow 30 minutes for the hand-over upon your return.

You will return with the toilet cassette and the interior clean and in the same condition as they were at the start of the hire, otherwise a charge will be made for additional valeting and or upholstery cleaning.

In addition, a separate toilet cleaning fee will apply if the toilet waste tank is not empty on return. Please see section REFUNDABLE SECURITY DEPOSIT for further details. Please note: there are no toilet emptying facilities at our return locations so this must be emptied prior to return.

Late return: If you will be late returning, you must advise us immediately. Failure to advise may result in prosecution for driving whilst uninsured.

An additional charge of £75.00 per hour will be payable for all late returns. 

You should allow plenty of time to return on time as traffic congestion can occur during peak times and high season.

The motorhome keys MUST be returned to CMH personnel as we have NO drop box facility and is a condition of the insurance.

Except as otherwise expressly provided in these terms and conditions late pick-up or early return of the motorhome does not entitle you to any refunds.

Insurance

Fully comprehensive insurance is provided as part of your hire for the motorhome.

The motorhome is covered against accidental damage by fire, theft or attempted theft during the period of hire.

As is the case with ALL motorhome hire companies there is the damage excess charge of £1000 is applicable regardless of who is at fault.

In the event of an accident the damage excess charge will be refunded only if we are successful in recovering the cost of the damages from the third party. This damage excess charge will be taken from the Security Deposit as per Refundable Security Deposit section.

You can purchase a CDW policy to reduce the damage excess charge liability to zero, please ask for details at the time of booking (see next paragraph).

The motorhome is insured for the agreed period of hire only, if you return the motorhome late you will not be insured, and you may be committing a traffic offence under the Road Traffic Act.

If you are forced to return late you must notify us by telephone before your agreement expires.  Late return fees apply

You understand that:

You are not covered for damage or theft to your own personal property – we strongly recommend that you take out personal travel insurance to cover your own possessions.

Any claim on insurance will not be considered if the motorhome was being used in contravention to these terms and conditions.

Exclusions from the insurance policy, for which you will be totally liable and from which you indemnify us, include:

In other words the following are not covered by insurance and in the event of the following the cost will be deducted form the Security Deposit:

Damage to tyres by punctures, cuts or bursts, damage or loss to in-motorhome entertainment systems.

Theft involving deception.

Theft as a result of keys remaining in the motorhome whilst it is unoccupied.

Damage to windows or a windscreen.

Any damage to the interior of the motorhome, including cigarette burns, spillages, marking, living or cooking equipment , damage to blinds, floor, table-tops and kitchen work surfaces, shower cubicle, carpets and any other damage.

Any costs resulting from the improper use of the motorhome.

Any fines or penalties resulting from an offence against the Road Traffic Regulation or Offenders Act, and for any Congestion Charge penalties incurred.

Any damage caused to the motorhome above cab height.  This is defined as above 6 feet (1.83m) from ground level

Damage to the motorhome or third-party property caused through a reversing manoeuvre or impact caused by tail swing of the motorhome.

Damage to or replacement of rear bumpers, rear light cluster, side skirt plastics, awnings, wing mirror casings and mirrors, exterior running light, habitation windows, skylight windows.

Damage caused to the canopy of the motorhome by trees, barriers or bridges etc.

The cost to retrieve or recover a motorhome that has become bogged or abandoned.

The cost of replacing keys, which have become lost or stolen, or which have been locked in the motorhome.

Mechanical, electrical, computer failures, breakdowns or breakages as a result of your negligence.

Loss of use, wear and tear, depreciation in value of the motorhome after a claim has been made under the insurance policy or against the security deposit.

Claims involving fraud or deception.

Theft as a result of keys remaining in the motorhome whilst unoccupied.

The first 25% of the value of any claim for loss or damage following theft or attempted theft of the motorhome.

Loss or damage to, or theft of, the Ariel, TV, Radio stereo equipment, Sat Nav, European Travel Pack, Euro Kit and its contents, Gas-It set, First Aid kit, Tables and chairs, Crookery cutlery pots and pans, Reversing camera monitor and lens, Bike Rack, Fire extinguisher and fire blanket,  Large UK and European road Atlases, Carbon monoxide and smoke alarm, Electric hook up cable, Fresh water filling hose, EU adaptor, Kettle, Toaster, instruction manuals.

Vandalism damage of any kind to the motorhome.

Damage or loss of personal effects within or from the motorhome.

Damage to the motorhome clutch as a result of your negligence.

Damage and or repair due to frozen pipe work or systems to include water tank

Damage to hot water tank if gas or electric is used when tank is empty or as a result of your negligence.

The cost of repairing any damage caused by wilful misconduct (e.g. sitting on the roof).

You are strongly advised to take out additional travel insurance, as you may be able to claim against it for such exclusions should the need arise.

In the event of an insurance claim you must provide full and accurate information in line with the disclosure requirements of the insurer. In the event of the motorhome insurance being invalidated because of a breach of this provision you will be responsible for payment in full and indemnifying us (if applicable) of all losses, fines, expenses, costs and damages we or you suffer or incur as a result

CDW (Collision Damage Waiver - insurance to cover insurance excess)

You can purchase a CDW policy to cover the Insurance Excess charge of £1000 in the event of a road traffic accident (RTA). This will reduce your liability to zero or what ever the policy stipulates.

For further information please ask at the time your make your booking.

Please note you can not add a CDW policy after you collect your motorhome.

If CDW is taken, the hirer will however be fully liable for any overhead damage, damage caused through reversing, replacement or repair to windows, mirrors, any internal damages or any damage costs caused through gross negligence or not covered by the CDW.

You understand that in the event of you purchasing a CDW policy and having to claim on this policy as a result of a RTA the Insurance Excess Charge will still be retained from your Security Deposit until such times when the CDW insurer settles the claim on your behalf when at which time the Insurance Excess charge will be returned to you.

Refundable Security Deposit

As is the case with ALL motorhome hire companies there is refundable security deposit of £1000 that covers both the insurance excess in the event of a road traffic accident (RTA) and the proper return of the motorhome in same condition as it was let out to YOU the customer.

The customer must pay the refundable security deposit by credit or debit card at the time of collection. No other form of payment is accepted.

Providing that the motorhome is returned on time, to the correct location, undamaged, with a clean interior, empty toilet cassette, full fuel tanks and no excess charges are due the security deposit will be refunded to you within 21 working days from the motorhome return date.

This is to allow time for any possible parking or speeding tickets to arrive.

The card should be in the lead driver’s name and the amount will be debited from your account immediately.

If another persons card is used that person should be present and or authority provided.

Pre-paid currency cards cannot be accepted.

CMH reserve the right to increase the security deposit if our insurers request this.

You authorise CMH to deduct from the security deposit any amounts due in respect of any breakages or damage to the motorhome or any other costs we incur as a result of your use of the motorhome.

We reserve the right to retain monies from your security deposits as follows:

Soiling fee £100 if the motorhome is not returned with the interior in a clean condition.

Toilet emptying fee £75 if the toilet is not returned empty & clean.  Please note: there are no toilet emptying facilities at our return location so this must be emptied prior to return.

Fuel surcharge of £25 if the tank is not returned full plus the cost of fuel.

You agree that you will be responsible for full payment of any sums due to us should the Security Deposit you have paid not be sufficient to cover the cost of any damage or other costs as set out in these Terms & Conditions.

You agree to indemnify us for all costs, damages expenses claims and losses which we incur suffer or become responsible for as a result of any act or omission by you which results in our being unable to receive full payment for such costs, damages, expenses claims and losses under the insurance cover referred for which we are unable to receive full payment under the insurance cover referred to.

Cheques or Cash are not accepted for security deposits.

Fuel and Oil, Gas and Water

A full tank of diesel PLUS a full tank of Gas is supplied with the motorhome at the commencement of the hire and we expect and require both tanks to be returned full.

A £25.00 charge plus VAT will apply for any fuel or gas shortage PLUS the amount needed to fill the tank. This will be taken from the security deposit.

There is a local petrol station to enable you to fill both tanks prior to returning the motorhome.

It is the customer’s responsibility to check and maintain oil and water levels to motorhome specifications.

It is the customer’s responsibility to check the tyre pressures of the motorhome, these are clearly marked above each wheel arch / in the hire guide

It is the customer’s responsibility to check connection of new gas bottles for leaks if a new bottle is needed, however this will only be in the event of a bottle replacement.

Any cylinders lost or incorrectly exchanged will be charged to the customer. This will be taken from the security deposit.

A full tank of water is supplied with the motorhome at the commencement of the hire we DO NOT require a full tank on return.

The grey water tank (waste ) will be empty at the start of your hire, we do expect this tank to be empty on return, if not we will charge £15.00 plus VAT against your security deposit.

Miles allowed and destination

For a hire duration of 4 nights and over the mileage allowance is UNLIMITED.

For a hire duration of 3 nights the mileage allowance is 600 miles in total, any miles over this will be charged at £1 per mile and taken from your security deposit.

As part of our agreement with our insurers all our motorhomes are fitted with TRACKER devices that give constant updates on the whereabouts of the vehicle.

In the event you travel outside of an agreed territory/destination we will be notified and your insurance will be invalidated.

The authorities will be notified and we reserve the right to instigate criminal proceedings and recover the motorhome forthwith and you will lose your security deposit forthwith and you will be liable for any further costs in relation to the recovery of the motorhome.

 

Rates & Conditions

Prices and conditions quoted on our website or documentation are subject to change without notice.

All prices are quoted in UK pounds sterling and include VAT.  If Sterling is not your home currency you can opt to pay in your home currency if paying by debit or credit card.

Once you have made your booking and paid the deposit, the cost of your hire will not normally be subject to any change. This does not apply to invoice errors or omissions.

Once a booking has been made, offers and discounts cannot be applied retrospectively.

The balance of the price of your hire must be paid a minimum of 8 weeks before your arrival date. If you are booking within 8 weeks of departure full payment is due at the time of booking.

If the balance is not paid in time, we may cancel your booking and retain your deposit.

Cancelling Your Booking

You will incur the following charges if you cancel your booking:

Cancellation more than 8 weeks before your collection date, cancellation charge is £360 (£300 + vat) non-refundable deposit.

Cancellation between 8 and 4 weeks before your collection date, cancellation charge is 50% of total price of booking.

Cancellation between 4 weeks and your collection date OR No Show, cancellation charge is 100% of total price of booking.

You may cancel your booking at any time. Your notice of cancellation must be in writing and will only take effect on the date it is received at our office.

Where a refund is due after any cancellation charge has been taken into consideration (and provided we have received full payment from you) we will make the refund within 21 days of receiving notice of cancellation.

Note that if the reason for cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim these charges. We strongly recommend that you take out separate travel insurance. It is your responsibility to ensure that the travel insurance you purchase is adequate for your particular needs. We do not check travel insurance policies.

We cannot postpone or transfer money from one hire to another.

Changes to Your Booking

If, after we have confirmed your booking, you wish to change your travel arrangements in any way we will do our utmost to make these changes, but it may not always be possible.

The price of your hire may increase or decrease to reflect the changes made. We also reserve the right to impose an administration fee which will be advised to you at the time you request the change.

Force Majeure – if we change OR cancel your Booking

If, due to circumstances beyond our control, the motorhome booked is not available, we reserve the right to offer a suitable alternative or provide a full refund of monies paid to us.

CMH accepts no liability for any consequential losses or costs incurred by the customer, e.g. ferry tickets, loss of holiday etc. Customers are advised to take out their own travel insurance policy to cover such losses/costs. 

CMH may cancel the hire if, at the time of collection, the nominated drivers' licences or proof of address requested are invalid or not in accordance with the Terms and Conditions (see above). Provisional driving licences are not acceptable. In these circumstances, all monies paid by the Customer (except the refundable security deposit) will be forfeited to CMH. It is the Customer's responsibility to ensure that all agreed drivers are licenced to drive the motorhome in line with our Terms and Conditions. 

 

It is sometimes inevitable that we will have to change or cancel your hire for say the following reasons:

A motorhome being returned damaged resulting in its unsuitability for hire. 
The late return by a previous customer.

 

We therefore reserve the right to make such changes and cancellations should they become necessary although we will try to minimise the chance of such an event.

If your chosen specification of motorhome is not available, for instance following damage by a previous customer, we will aim to offer you another motorhome in its place if one is available.

If the replacement motorhome is lower price or less well equipped than your original booking we will refund the difference in price only.

If the replacement motorhome is higher priced than your original booking you will not be held liable for any higher rental charges.

We are not liable for any additional expenses incurred by you, e.g. higher ferry charges or road tolls, campsite fees.

 

If a suitable alternative motorhome is not available CMH reserves the right to cancel the hire, in which event we shall refund the hire charge to you in full and our liability to you shall be limited to the amount of the hire charge.

 

Except as expressly set out elsewhere, we regret that we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by or you otherwise suffer any damage or loss as a result of “force majeure”. In these terms and conditions, “force majeure” means any event which we could not even with all due care, foresee or avoid. Such events may include threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control as described above.

Suitable Persons

CMH reserves the right to refuse to hand over a motorhome to any person who, in the reasonable opinion of CMH is not suitable to take charge of the motorhome.

In such cases of refusal, all payments made by the customer will be refunded in full, but CMH will have no further liability in relation to the aborted hire, or to the person to whom hire was refused.

CMH reserves the right to cancel the hire if at collection date or at any time during the Rental Term if it becomes apparent that any of the drivers' licence(s) are invalid or not in accordance with the information supplied. In these circumstances all payments made by the customer will be forfeited.

European Travel

Customers travelling within Europe an additional charge of £10 per night for European cover (including European roadside assistance). European cover is mandatory and you will be in breach of these terms and conditions and will lose your security deposit forthwith.

Minimum charge term for European cover is 7 nights

The following Countries are covered by the European Travel Insurance.

Austria - Belgium - Denmark - Finland - France – Germany - Greece - Hungary - Italy - Luxembourg - Netherlands - Norway – Poland - Portugal -Spain - Sweden - Switzerland

Travel outside of these countries listed above will be in breach of these terms and conditions and you will not be covered by any insurance. Please check your route carefully and ensure it doesn’t go outside these countries.

Ireland Travel

Customers travelling to Ireland there is an additional charge of £5 per night for your Ireland cover (including Irish roadside assistance). Ireland cover is mandatory and you will be in breach of these terms and conditions and will lose your security deposit forthwith.

Minimum charge term for Ireland cover is 7 nights.

Parking

You may leave one car in our secure compound while you are away free of charge, however, vehicles are left entirely at your own risk and we accept no responsibility for any loss or damage which may arise.

Pet Policy

Pets are ONLY allowed in our Pet OK Motorhomes which are exclusively kept for pet owners to use.

If you allow any pets inside a non Pet OK Motorhome you will lose your security deposit forthwith.

All customers must agree sign and adhere to our strict Pet policy as follows:

No more than one pet is allowed per motorhome at ANY one time.

Do not allow your pet onto the upholstery, seats, mattress as any damage or stains will be charged accordingly.

**Please bring a pet blanket with you**

Do not leave your pet unattended /alone at any time in the motorhome.

No pet cages of any description allowed into our motorhomes as damage / scratches to woodwork can be expensive to repair and will be charged accordingly.

Festival Hire Policy

Festival hire is ONLY allowed with written permission from CMH

If you attend a Festival without our knowledge you will lose your security deposit forthwith.

The security deposit automatically increases to £1500 for a Festival Hire

All our motorhomes have a tracker and any customer who is not truthful will lose the security deposit if the motorhome joins a festival without our consent and knowledge.

Use of the Motorhome

Whist you are hiring the motorhome you will not:

Operate the motorhome, or permit the motorhome to be operated in any way that would violate this agreement including, for the avoidance of doubt, for commercial or business purposes.

Permit anyone other than the driver(s) named on the booking form to drive the motorhome.

Engage in motor sports, including racing, pace making, rallying, reliability trials, and speed testing.

Propel or tow any motorhome or trailer unless agreed by us in writing at the time of your booking.

Drive or permit to drive any person unfit through drink or drugs or with blood alcohol concentration above the limit prescribed by road traffic legislation.

Leave the motorhome unlocked while unattended, or fail to secure the keys.

Drive other than on a paved public highway, private road, or driveway. Driving onto official campsite fields is permitted but you should take reasonable precautions to ensure that the ground is suitable, and you will be able to drive off the field. Even if a motorhome is designated as a four-wheel drive, it is not to be taken off-road as the four-wheel drive provides a safety feature for winter driving only.

Drive in a reckless or imprudent manner.

Drive onto beaches or anywhere where water may contact the motorhome

Carry more passengers than the seating capacity of the motorhome.  Please note number of seat belts listed on the motorhome you are hiring.

Allow the motorhome to be overloaded.

Carry passengers or goods for hire or reward.

Smoke or permit anyone to smoke in the motorhome.

Use the motorhome in violation of any law, ordinance or regulation.

Remove the motorhome from England, Scotland, Wales or Ireland without our prior written consent.

Allow any animals in the motorhome without our prior written consent.

You will take all reasonable steps to maintain the motorhome, ensuring that the oil level, water level & tyre pressures are correctly maintained during your hire.

You will contact us immediately should any motorhome warning lights indicate a potential malfunction.

You will use the correct legal fuel type for the motorhome as advised by us at the time of collection of the motorhome.

 

Road Restrictions

All Motorhomes may only be driven on sealed / bitumen roads NOT off road or beaches.

I acknowledge that CMH reserves the right at any time, at its sole discretion, to restrict motorhome movements in certain areas due to adverse road or weather conditions or any other reasonable cause.

In the event of a breakdown

You should seek the help of the breakdown services.  Details are held within the motorhome

Any call out charges necessitated by the customer through operator error, e.g. a flat motorhome battery, wrong or insufficient fuel, keys locked in motorhome etc. will be the responsibility of the customer.

You are authorised to approve repairs up to £50.

Any repairs in excess of £50 must first be authorised by us, prior to the work being undertaken.

In all cases VAT receipts must be submitted for any repair or the claim will not be paid.

You and not us will be liable for the cost of any repairs, or other costs incurred, resulting from reckless, negligent or imprudent use of the motorhome by you or permitted by you including, for the avoidance of doubt, the cost of towage, replacement motorhome or car hire.

You will notify us by telephone of the breakdown as soon as possible in order to give us the opportunity to rectify the problem during the rental.

If a repair cannot be completed within 24 hours, and it is not the result of reckless, negligent or imprudent use of the motorhome by you or permitted by you, we will endeavour to help you by providing either a replacement motorhome (if available).

You are responsible for making your own way to our Bristol depot to pick up a replacement motorhome; we may offer you the option of paying for an alternative motorhome to be delivered your location if there is a motorhome available.

We will not be liable for any other costs incurred. All other conditions will apply.

Compensation may be paid at our discretion. In all cases compensation is limited to the cost of the disrupted rental days.

Compensation will only be paid if the motorhome is rendered unusable by the breakdown.

Compensation will only be paid where the breakdown occurs as a result of our failure to use reasonable care & skill (e.g. in relation to servicing the motorhome).

You will be liable for any cost associated with the incorrect or illegal use of fuel (fuel being petrol or diesel) or water contamination of fuel including, for the avoidance of doubt, any necessary repair or drainage work, towage, and the cost of hiring a replacement motorhome or car hire.

You will be liable for any cost associated with fuel contamination of the fresh water system, including, for the avoidance of doubt, any necessary repair, including replacement plumbing and decontamination. 

The customer will also pay CMH the daily hire rate for the period the motorhome is undergoing repairs or rendered off road and therefore unusable for hire if the repair/reason is as a result of the customers negligence/fault.

In the event of an accident

If you are involved in a motor motorhome accident the following procedures should be followed:

Obtain the names and addresses of third parties and witnesses.

Report the accident to the police (call 101), regardless of estimated cost.

Do not accept blame or insist the other party is at fault.

If possible photograph damage to all motorhomes involved and registration numbers.

During the motorhome return process you must hand over any police reports or photographs, pay the damage excess charge. We will ensure that an accident report is completed clearly and signed by the customer.

Depending on availability, and at our discretion, we will endeavour to provide a substitute motorhome, subject to location, accident liability & remaining hire duration.

You are responsible for making your own way to our Bristol depot to pick up a replacement motorhome; we may offer you the option of paying for an alternative motorhome to be delivered your location if there is a motorhome available.

We will not be liable for any other costs incurred. All other conditions will apply.

We will endeavour to ensure any monies due back to you are forwarded as quickly as possible, however third party claims can take a long time to resolve.

You agree to provide all reasonable assistance to CMH in handling any claim including providing information and attending court to give evidence.

Compensation may be paid at our discretion. In all cases compensation is limited to the cost of the disrupted rental days.

Compensation will only be paid if the motorhome is rendered unusable by the accident.

Compensation will only be paid where the accident occurs as a result of a third party 100% blame, in other words not the customers fault, and only when we have successfully made a claim for your loss of rental.

The customer will also pay CMH the daily hire rate for the period the motorhome is undergoing repairs or rendered off road and therefore unusable for hire if the repair/reason is as a result of the customers negligence/fault.

Note: under no circumstances should you attempt to start or drive a motorhome that has been involved in an accident, roll over or submersion without our written permission.

Motorhome Systems

CMH will carry out a full Pre-Checkout Inspection (PCI) on every motorhome before the commencement of hire. The PCI involves testing every system on board the motorhome to ensure they are operating correctly. In conjunction with this the customer will be taken on a tour of the motorhome and shown how each system works (and that it works). Should an onboard system fail during your hire, we will make every effort to remedy the fault whilst you are away but in some cases, this may not be possible, and we cannot be held responsible and will not refund any monies should a loss of service be encountered.

In the event of a puncture or damage to tyres

You are liable for the cost of any damage or punctures.

In the event that a tyre is returned damaged, at the end of your hire, it will be at our discretion whether to repair or replace it.

If you have a puncture during your hire you may use the breakdown service to replace the tyre.

You will arrange for the puncture to be repaired, or the tyre replaced, as soon as possible after the incident.

Tyre type and brand must be approved by us prior to instructing work.  Tyres to a comparable (as other tyres on motorhome) specification and price must be selected.  If lower specification or budget tyres are selected without our approval we reserve the right to replace to the correct standard and charge the full cost of the new tyre.

Generators

Generators are not permitted without exception any customer who is found to have taken a generator will lose the security deposit forthwith.

Smoking

Smoking is not permitted without exception in any motorhome. Failure to comply or any evidence found the customer will lose the security deposit forthwith.

Alterations to the Motorhome

The customer shall not make any alterations or additions to the Motorhome without the prior written consent of CMH

Motorhome title and ownership

The customer acknowledges that CMH retains the title to the motorhome at all times. You will not attempt, agree, offer or purport to sell, assign, sub-let, lend, let on hire or otherwise part with or attempt to part with the possession of the motorhome.

Administration Charges

You are entirely responsible for any speeding, parking, congestion charge or other road fines and penalties incurred during your hire.

The administration fee per incident will be £55 and will be deducted from your security deposit or if already returned will be requested and payment be made within 7 days.

Payments by Credit/Debit Card

When payment is made by credit/debit card you agree that:

We are authorised to charge any amounts due under this agreement to the customer’s card including any damage excess charge costs.

You authorise CMH to recover payment from your card of any charges pursuant to this agreement which were not known at the time of return of the motorhome. We may process card charges pertaining to the rental after the hire period.

All transactions are in UK Pounds Sterling. Due to exchange rate fluctuations there may be some variance between the amount initially charged to a customers’ card and any refunds subsequently applied, we accept no responsibility for any such charges.

Release and Indemnity of CMH

Subject to its obligation to deliver the motorhome or an appropriate substitute motorhome, you release CMH, its employees and agents, from any liability to you (regardless of who is at fault) for any loss or damage incurred by you by reason of this Agreement, including but not limited to:

Any loss or damage caused by breakdown, mechanical defect, accident or the motorhome being unsuitable for my purpose;

Any loss or damage to any property left in or on the Motorhome, in any service motorhome or on any CMH premises or recovered or handled by CMH.

Subject to any insurance arrangements agreed with CMH, I hereby indemnify and shall keep indemnified CMH, its employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by them or any of them by reason of my use and/or possession of the motorhome.

Changes

Any changes to this agreement must be in writing and must be signed on behalf of CMH and by the customer.

Terminating the Agreement

You acknowledge that we may terminate this agreement and repossess the motorhome at any time in the circumstances set out below.

You will pay reasonable costs of repossessing the motorhome if:

You are in contravention of this agreement in any manner, or

We believe that you have hired the motorhome through fraud or misrepresentation, or

The motorhome appears to be abandoned, or

The motorhome is not returned on the agreed day or we believe that the motorhome may not be returned on the agreed date, or

On reasonable grounds, we believe that the safety of the passengers or condition of the motorhome is endangered.

You understand that, in the event of such termination or repossession except as otherwise expressly set out in these terms and conditions you have no right to a refund of any part of the rental charges or the security deposit. 

Privacy Policy

We do not store credit or debit card details.

Law

This agreement is governed in all respects by English Law and you submit to the jurisdiction of the English Courts.

You warrant that all information supplied by you to CMH in connection with this agreement is true.

This agreement constitutes the entire agreement of the parties and there are no other undertakings or agreements between the parties relating to the subject matter of this agreement.

We reserve the right to vary the rates and conditions of hire at any time. 

Entire Agreement

This Agreement constitutes the entire agreement of the parties and there are no other oral undertakings, warranties or agreements between the parties relating to the subject matter of this agreement. CMH reserves the right to add or amend the motorhome specifications and rental charges without prior notice.

This agreement does not affect your statutory rights under civil law.
